# TERMS OF SERVICE


1. General Terms

These quotes are only for personal use. Please note that if the artwork is going to be exploited, fees can go up to +150% - 350% of the base price:

**For Personal Use:**  

The base price is applied. The client is free to use the artwork for non-commercial purposes, such as printing the artwork for themselves, showing it online (credit is required), and displaying it as they please. The sale of any material featuring or derived from said commission is not allowed. If the client wishes to use the piece commercially after the commission is completed, this can be discussed, and a fee will be applied.
 

**For Commercial Use:**  

A +150% fee on top of the base rate will be applied for any commercial advantage or monetary compensation. Using images on or in anything created with the intention of making a profit is considered commercial use. I, the artist, maintain ownership of said artwork for my own personal and commercial use and to display it in my portfolio and on social media.
 

**Exclusive Rights:**  

A +350% fee on top of the base rate applies for commissions that give the client complete ownership of the artwork. Exclusivity transfers ownership of the actual piece of artwork and all associated rights (intellectual property) to the client. The use and display of said piece are allowed only to the client.

Prices provided on the price list are not set; they serve as an orientation and are subject to change based on demand. I reserve the right to accept or refuse any order for any reason.
 

2. What I Need to Know
 

  • - Name / desired pronouns

  • - Commission type (bust, half-body, etc.) as well as the add-ons or desired background

  • - Brief description and references, if any

  • - Orientation (portrait, landscape, square crops, etc.)
     

  • Note that I will do my best to follow the overall character design but may not match it 100% in various cases. My artistic interpretation will take precedence.
     

3. Process and Delivery
 

  • After I have accepted your commission, the process will be shared with you regularly to provide any feedback and corrections you might have. You must approve these so I can continue the work.

 

  • Delivery times can vary between 2 weeks and 3 months depending on factors such as the complexity of your request and my health. Each piece is unique and personalized; some can take just a few weeks while others take longer.

 

  • Once the piece is finished, you will receive the full-resolution image. Note that there isn’t any physical product. If you need a particular file format or size, mention it before I start working on your commission.
     

4. Payment
 

  • The accepted currency is Euro, and payment can be made through PayPal or Ko-fi. Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval, excluding sketch commissions. Do not send any payment before I have agreed to give you a slot and requested you to send the payment.
     

5. Revisions Policy
 

  • The commission includes 3 revisions. Additional revisions will incur a fee of 10euros. This ensures that the process remains efficient and fair.
     

6. Client Responsibilities
 

  • Clients are expected to provide clear instructions, timely feedback, and necessary references to avoid delays and misunderstandings. This helps ensure the final artwork meets expectations.
     

7. Copyright & Usage
 

  • I, Enahile (referred to as the artist):

 

  • - Have the right to cancel and refund the order at any time for any reason.

  • - Retain all copyrights over the commissioned artwork, unless they have been purchased.

  • - Reserve the right to post the commissioned artwork online, in my portfolio, and in publications such as art books.

  • - Will not profit further from the commissioned artwork unless you (the customer) break any of the terms

    You (the customer/commissioner):
     

  • - May upload the commissioned artwork on any website and social channels - as an icon for a personal website/blog or wallpaper as long as it is not monetized.

  • - May NOT make profits from the commissioned piece unless you have paid for the rights (reselling, redistributing, uploading to POD services, making prints, etc.).

  • - May NOT alter the commissioned artwork without my (the artist's) consent. This also includes Sketch Commissions - you may NOT work further on the commissioned artwork or ask someone else to redraw the commission.

  • - Retain the rights to the intellectual property (IP).

  • - May NOT use the commissioned artwork for commercial purposes unless you have paid for the rights.
     

The following is considered copyright infringement:
 

  • - Reproducing/using the copyrighted artwork commercially (making money off it in any way) unless we discussed it beforehand.

  • - Claiming the artwork as your own.

  • - Altering the artwork without my consent.
     

  • In some cases, the commercial rights to the image may be purchased.
     

8. Refund Policy
 

  • No refund will be made if I have already started working on your order. If you request a PayPal chargeback at any point when you were not allowed to ask for a refund, you will lose all aforementioned rights to the commissioned piece, and I will have the full right to profit further from it in any way.
     

  • I will decline the chargeback and supply PayPal with our conversations as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me again.
     

9. Confidentiality
 

  • If your commission involves sensitive information or is not to be shared publicly, please inform me, and I will ensure it remains confidential.
     

10. File Storage
 

  • I will keep the files for 3 months minimum after delivery. Clients are responsible for saving copies of the final artwork.
     

11. Dispute Resolution
 

  • In the event of a dispute, we will attempt to resolve it amicably through direct communication. If a resolution cannot be reached legal action will be pursued.
